Every employer with even one employee meets this deadline each winter, including families with a nanny. This post sets out the dates for the 2026 forms, who gets which copy, what counts as sending on time, and what happens if you miss it. It follows the IRS General Instructions for Forms W-2 and W-3 (2026).
The W-2 deadlines for 2026 forms
| Copy | Goes to | Due by |
|---|---|---|
| Copies B, C and 2 | The employee | February 1, 2027 |
| Copy A, with Form W-3 | Social Security Administration (paper or electronic) | February 1, 2027 |
| Copy 1 | State, city or local tax department, if required | Set by the state or locality |
| Copy D | Your own records | Keep it |
January 31 is the normal date. The IRS moves a due date that falls on a Saturday, Sunday or legal holiday to the next business day, and January 31, 2027 is a Sunday. The 2027 forms will be due on Monday, January 31, 2028.
What counts as sending a W-2 on time?
- By mail: the instructions say you meet the furnish requirement if the form is properly addressed and mailed on or before the due date.
- By hand: give it to the employee by the due date.
- Electronically: allowed only if the employee has consented. IRS Publication 15-A sets out the consent rules, including telling the employee how to get a paper copy.
- To the SSA: paper Copy A must travel with Form W-3. Online, SSA Business Services Online lets you key in W-2s and builds the W-3 automatically.
You must file electronically if you are required to file at least 10 information returns in the year, counting W-2s and other information returns such as 1099s together.
Former employees and businesses that close
If someone left during 2026, you can give them the W-2 any time after the job ends and no later than February 1, 2027. If they ask for it, the instructions require it within 30 days of the request or of the final wage payment, whichever is later. A business that stops operating has earlier deadlines, covered under "Terminating a business" in the instructions.
Can you get an extension for W-2s?
Only narrowly, and there are two different requests.
| Extension | Form | Length | Granted when |
|---|---|---|---|
| Time to file Copy A with the SSA | Form 8809, before the due date | One 30-day extension | Only in limited cases of extraordinary circumstances or catastrophe |
| Time to give employees their copies | Form 15397, by the due date | Generally no more than 15 days | Not automatic |
An extension to file with the SSA doesn't extend the employee deadline: employees still need their copies by February 1, 2027.
What is the penalty for late W-2s?
The penalty is per form and applies separately to filing with the SSA and to giving employees their copy. For information returns due in 2026, the IRS lists these amounts. The figures are adjusted for inflation each year, so check the IRS page for returns due in 2027.
| When filed or furnished correctly | Penalty per form |
|---|---|
| Within 30 days of the due date | $60 |
| 31 days late through August 1 | $130 |
| After August 1, or not at all | $340 |
| Intentional disregard | $680, with no annual maximum |
Wrong information counts too: the instructions apply the penalty to a W-2 that leaves out required information or shows incorrect information. Correct a filed W-2 with Form W-2c.
What's new on the 2026 Form W-2
The 2026 instructions add three box 12 codes: TA for employer contributions to Trump accounts, TP for the total cash tips reported to the employer, and TT for qualified overtime compensation. Employers who paid FLSA overtime or had tipped staff in 2026 need those totals from their payroll records before January. Our no tax on overtime and no tax on tips posts explain the overtime and tips amounts.
Where PayDocs fits
The PayDocs W-2 generator makes the employee copies of the 2026 Form W-2 (Copies B, C and 2), including box 12 codes, from your year's totals. You preview them free, and the copies show only the last four digits of the employee's SSN, which the IRS allows on employee copies.
PayDocs doesn't make Copy A or Form W-3 and doesn't file with the SSA. File those through SSA Business Services Online or your payroll provider. This is general information, not tax advice.
Questions
When do employers have to send W-2s for 2026?
By February 1, 2027, both to employees (Copies B, C and 2) and to the Social Security Administration (Copy A with Form W-3). January 31, 2027 is a Sunday, so the deadline moves to Monday.
Does the W-2 have to arrive by the deadline or be mailed by it?
Mailed. The IRS instructions say you meet the requirement if the form is properly addressed and mailed on or before the due date, so a W-2 posted on February 1, 2027 is on time.
Can I get an extension to send W-2s to employees?
You can ask on Form 15397 by the due date, but it isn't automatic and is generally no more than 15 days. The Form 8809 extension covers filing Copy A with the SSA only, and only in extraordinary circumstances.
What is the penalty for a late W-2?
For returns due in 2026, $60 per form within 30 days, $130 through August 1, and $340 after that or if never filed, applied separately to the SSA filing and the employee copy. The amounts rise with inflation each year.
Do household employers have the same W-2 deadline?
Yes. A family that must give a nanny or other household employee a 2026 W-2 has the same February 1, 2027 date for the employee copies and the SSA filing.
