Every employer who files a Form W-2 also files a Form W-3, including a family with one nanny. The W-3 carries no new information: it adds up the W-2s in the bundle so the Social Security Administration (SSA) can check that the totals match. This post covers who files it, when, how to fill in each box for 2026 wages, and how to avoid the mismatches that bring letters from the IRS.
What is Form W-3?
Form W-3 is a transmittal: a cover sheet with totals. The IRS General Instructions for Forms W-2 and W-3 (2026) say that anyone required to file Form W-2 must file Form W-3 to transmit Copy A of the W-2s. Both go to the SSA, not to the IRS, and the employee never sees the W-3.
Household employers are not an exception. The instructions say that even an employer with only one household employee must file a W-3 with that employee's Copy A, check the "Hshld. emp." box, and have an employer identification number (EIN). Keep a copy of the W-3 and of each Copy A for at least 4 years.
| Document | Who gets it | Due |
|---|---|---|
| Form W-2 Copies B, C and 2 | The employee | February 1, 2027 |
| Form W-2 Copy A | Social Security Administration | February 1, 2027 |
| Form W-3 (with Copy A) | Social Security Administration | February 1, 2027 |
| Form W-2 Copy 1 | Your state, city or local tax department, if required | Set by that department |
When is Form W-3 due?
For 2026 wages, Form W-3 and Copy A of every W-2 are due at the SSA by February 1, 2027, whether you file on paper or electronically. Employees must have their copies by the same date.
Extensions are narrow. You can ask for one 30-day extension to file with the SSA on Form 8809, before the due date, and the IRS grants it only in extraordinary circumstances or catastrophe, such as a fire destroying your records. An extension to file does not extend the date for giving employees their copies; that has its own request, Form 15397.
Do you have to e-file the W-3?
You must e-file if you are required to file at least 10 information returns in the calendar year. Count your Forms W-2 together with other information returns such as the Form 1099 series, Forms 1095-B and 1095-C and Form 1098. Ten or more in total means every W-2 goes electronically.
Below that, you choose, and the SSA encourages every employer to e-file through its Business Services Online (BSO). For 50 or fewer W-2s, BSO's online fill-in forms let you create, save, print and submit them, and BSO generates the W-3 automatically from your W-2s. For more than 50, BSO's file upload is usually the better route. Don't also mail paper copies of anything you e-filed.
If you file on paper, the SSA accepts only the official red-ink forms or approved substitutes. The IRS says not to print Copy A of Form W-2 or Form W-3 from IRS.gov and file it: the copies posted there are for information. Order the scannable forms, type in black ink, and don't staple, tape or fold anything. Mail Copy A with the W-3 to: Social Security Administration, Direct Operations Center, Wilkes-Barre, PA 18769-0001.
BSO now needs extra identity checks. The IRS instructions ask new users to allow at least 2 weeks to complete BSO registration, so set it up in December rather than in late January.
How to fill in Form W-3, box by box
The money boxes on the W-3 are totals from the W-2s in this bundle only, leaving out any W-2 marked "VOID". The other boxes describe you as the employer.
| Box | What to enter |
|---|---|
| a, Control number | Optional, for your own numbering |
| b, Kind of Payer | One box: 941, Military, 943, 944, CT-1, Hshld. emp. or Medicare govt. emp. |
| b, Kind of Employer | One box: None apply, 501c non-govt., State/local non-501c, State/local 501c or Federal govt. |
| c, Total number of Forms W-2 | How many W-2s are in this bundle, not counting any marked VOID |
| d, Establishment number | Optional, to separate locations under one EIN |
| e, Employer identification number | Your 9-digit EIN, never truncated; "Applied For" if you're waiting for one, never your SSN |
| f and g, Name and address | The same name you use on Form 941, 944, 943, CT-1 or Schedule H |
| h, Other EIN used this year | Any different EIN you used on 2026 employment tax returns |
| Contact person, phone, email | So the SSA can ask questions or tell you to resubmit |
| 1 to 8 | Totals of boxes 1 to 8 on the W-2s |
| 9 | Leave blank |
| 10 and 11 | Totals of dependent care benefits and nonqualified plans |
| 12a, Deferred compensation | Total of box 12 codes D to H, S, Y, AA, BB and EE, with no code |
| 13 | Leave blank (third-party sick pay use only) |
| 14 | Income tax withheld by a third-party sick pay payer, if any |
| 15 | State and your state ID; an X if the W-2s cover more than one state |
| 16 to 19 | Totals of state and local wages and income tax |
Which Kind of Payer box? A business that files Form 941 quarterly checks "941"; one approved to file Form 944 annually checks "944". A household employer who reports the nanny's taxes on Schedule H, not on Form 941 or 944, checks "Hshld. emp.". If you have two kinds of W-2, for example farmworkers and office staff, send each kind with its own W-3.
Reconcile the W-3 with your Forms 941 before you file
The SSA and the IRS compare your W-3 with your tax returns. Boxes 2, 3, 5 and 7 of all your 2026 W-3s should match the year's totals on your Forms 941 (or Form 943, 944, or Schedule H for a household employer). When they don't, you'll be contacted to explain the difference.
- Add up federal income tax withheld, Social Security wages, Medicare wages and Social Security tips from your four Forms 941.
- Compare each figure with W-3 boxes 2, 3, 5 and 7.
- Check that bonuses are in both W-2 wages and Social Security and Medicare wages: the IRS lists unreported bonuses among the common causes of mismatches.
- Check that Social Security tax is in W-2 box 4 and Medicare tax in box 6, not mixed into the wage boxes.
- Fix the W-2s first, then let the W-3 total them again. Keep your reconciliation working papers.
The SSA also rejects wage reports where Medicare wages are less than Social Security wages and tips, or where tax appears in box 4 or 6 with no matching wages. Household employers get a further check: reports showing Social Security or Medicare wages below the yearly minimum for a household employee are rejected.
What happens if you file the W-3 late?
The penalty is charged per W-2, not per W-3, and grows the later you file. These are the amounts the IRS lists for returns due after December 31, 2026, which includes 2026 W-2s due on February 1, 2027.
| When you file correctly | Per W-2 | Yearly maximum | Small business maximum |
|---|---|---|---|
| Within 30 days after the due date | $60 | $698,500 | $244,500 |
| After 30 days, by August 1 | $130 | $2,095,500 | $698,500 |
| After August 1, or never | $340 | $4,191,500 | $1,397,000 |
| Intentional disregard | At least $690 | No maximum | No maximum |
A small business here means average annual gross receipts of $5 million or less over the 3 most recent tax years. A separate penalty, applied the same way and with the same amounts, covers failing to give employees correct copies on time. The IRS can waive penalties for reasonable cause, and small errors in dollar amounts (no more than $100, or $25 for tax withheld) can fall under a safe harbor.
Where PayDocs fits
PayDocs makes the employee copies of Form W-2: Copies B, C and 2, filled in from your payroll figures, with up to four box 12 codes and the 2026 boxes 14a and 14b. You preview them free and pay per document. PayDocs doesn't produce Copy A or Form W-3 and doesn't file with the SSA, so you still file through BSO or with your payroll provider. Use the same figures for both, and the W-3 will agree with the copies your employees hold.
This is general information about federal rules for employers, not tax or legal advice. State and local rules can add to it.
Questions
Do I need a W-3 if I only have one employee?
Yes. The IRS instructions say anyone who files a W-2 must file a W-3, and that even employers with only one household employee must file one, checking the "Hshld. emp." box.
When is Form W-3 due for 2026 wages?
February 1, 2027, together with Copy A of each Form W-2, whether you file on paper or electronically. Employees must receive their W-2 copies by the same date.
Can I print Form W-3 from the IRS website and mail it?
No. The SSA accepts only e-filed reports and the official red-ink forms or approved substitutes. The IRS says Copy A and the W-3 posted on IRS.gov are for information and must not be printed and filed.
Do I file Form W-3 with the IRS?
No. Form W-3 and Copy A of the W-2s go to the Social Security Administration, either through Business Services Online or by mail to its Wilkes-Barre office. Employment tax returns such as Form 941 go to the IRS.
Do I need to fill in a W-3 if I e-file?
If you create your W-2s with SSA's Business Services Online fill-in forms, BSO generates the W-3 automatically from them. If you upload a file instead, follow SSA's EFW2 file format specifications.
